Copyright Implications of AI-Generated Music – Review of the Munich Regional Court “Suno” case (GRUR-Prax, 18/2026)

HOFFMANN EITLE associate Franz Osmar Münzner has contributed to the latest issue of GRUR-Prax with an article examining the copyright implications of AI-generated music, based on the Munich Regional Court’s recent decision in the Suno case.

Among other issues, the contribution addresses the reproduction of copyrighted musical works in AI models and the limits of the text and data mining exception under § 44b UrhG. It also considers the application of US fair use to AI training carried out in the United States in proceedings before German courts, as well as the court’s assessment of whether fair use could provide a defence in the case.

The article provides an in-depth analysis of these issues and the broader copyright questions arising from the use of protected works in AI training and AI-generated music.
