Indicative Effect of European Decisions on Similarity of Goods – Review of the Stuttgart District Court “Square Chocolate Packaging” case (GRUR-RR, 6/2026)

HOFFMANN EITLE partner Michaela Ring and associate Franz Münzner have contributed to the latest issue of GRUR-RR with an article examining the role of EUIPO decisions and case law from other EU Member States in assessing the similarity of goods and services in trademark disputes.

The article addresses whether such decisions should be taken into account as indicative guidance to support a more consistent approach across European jurisdictions. It further provides a detailed commentary on the Stuttgart Regional Court’s judgment (17 O 192/25) concerning the imitation of the well-known “square chocolate packaging”, with a focus on the court’s reasoning regarding the assessment of similarity of goods.
